As there have been several class action lawsuits filed against BMW over the past decade for similar issues, it is clear that the sunroof is defective in design, manufacturing, materials and/or workmanship. Furthermore, BMW has exhibited negligence as BMW has a knowledge of the defect in the sunroofs and never disclosed to owners or lessees that the defect exists or that drivers and occupants of the vehicles are at risk and that vehicles equipped with the sunroofs expose drivers and passengers to a risk of sudden explosion or shattering.
