The BMW dealership and BMW North America are unwilling to acknowledge the safety issue, issue a recall, or buy back. Safety issues are: •Delayed/hesitant response —a lag of up to several seconds between pressing the accelerator and the car actually moving, especially at low speed or when pulling out from a stop. •Jerky, clunky low-speed behavior — rough engagement in stop-and-go traffic or when transitioning between Park/Drive/Reverse. •Rollaway risk — Because the DCT uses electrohydraulic clutch actuation instead of a torque converter, some drivers say the car can roll backward (e.g., on an incline) before the clutch engages, rather than holding position like a traditional automatic. I've not noticed warning lights related to the problem, although the vehicle has a history of screens and monitor going black. Numerous close calls related to hitting other vehicles/pedestrians related to these unpredictable responses from the vehicle putting others at risk. 'Software updates' have reportedly been performed remotely and at the dealership, but the issue remains. As such, the vehicle has been at the purchasing dealership most recently for more than 4 months, with no meaningful response, and no prognosis.
